Consolidated Decision on the Wholesale Access to Data and the Provision of Publicly Available Directory Information Services

 

Providers of Publicly Available Telephone Services (PATS) are required to ensure that their subscribers are given the option to feature in directory information services.  The Malta Communications Authority (MCA) nonetheless identified the need to elaborate and give further clarity to the overall framework and process by which PATS providers obtain and share their subscribers' personal data for the purposes of the directory information services which they, and other directory information service providers, may offer.

Second Decision Notice
 
 
  The purpose of this consultation process is to propose linguistic clarifications to the Decision on Wholesale Access to Data for the Provision of Publicly Available Directory Information Services (‘the Decision’), dated 20 April 2015, with the aim of providing clarifications which will assist all operators in their implementation of the Decision. 
 
However, should the suggestions as put forward in this consultation be rejected, the text as originally drafted in the Decision shall apply.

Revision of Decisions 3 and 4 of the Decision on the Wholesale Access to Data and the Provision of Publicly Available Directory Information Services

 

In April 2014, following consultation with the public, the MCA published the Decision on Wholesale Access to Data for the Provision of Publicly Available Directory Information Services.  However, before this First Decision Notice became applicable, the MCA considered that a phrase used in Decisions 3 and 4 of the First Decision Notice could be misconstrued.  For this reason, on 16 November 2015, the MCA launched a second consultation process in order to consult limitedly on the re-wording of Decisions 3 and 4 of the First Decision Notice.  This consultation ended on 4 December 2015.

This document contains the Decision Notice amending Decisions 3 and 4 of the First Decision Notice while reporting on the feedback received from the relevant consultation process of November 2015.

Decision on the Wholesale Access to Data and the Provision of Publicly Available Directory Information Services.

Following a consultation which was issued in July 2014, the MCA is publishing a decision entitled ‘Decision on the Wholesale Access to Data and the Provision of Publicly Available Directory Information Services’.
 
This decision addresses the need for clarity and harmonisation on the elements of consent required to be given by subscribers to have their personal data made available for directory information services. It also lists the prerequisites that need to be met by an authorised directory information service provider to be in a position to request telephony providers share this data for directory information services.

On 21 July 2014, the MCA issued a Consultation Document entitled Wholesale Access to the Provision of Directory Information Services – Consultation and Proposed Decision (hereinafter the ‘First Consultation Document’) in accordance with Article 4A of the Malta Communications Authority Act (Cap. 418 of the Laws of Malta).
 

Wholesale Access to Data for the Provision of Publicly Available Directory Information Services: Consultation & Proposed Decision

    The MCA is consulting on the collation and sharing of personal subscriber data for the purposes of providing telephone directory information services.
     
    All feedback is to be sent to the Legal Unit by post at the MCA's Offices or via email at legal@mca.org.mt by 12.00hrs on Monday, 15 September 2014.
